SOL Note
PFAS SOL follows the discovery rule in most jurisdictions — it runs from when the claimant knew or should have known of the PFAS exposure connection to their diagnosis. Community contamination cases often pivot on the date of public disclosure of contamination.

The PFAS market
PFAS water contamination is one of the largest emerging environmental torts. Hundreds of municipalities and private wells have been contaminated with PFAS compounds from industrial discharges, landfill leachate, and legacy AFFF use at nearby bases or training facilities. The 3M $10.3B settlement with public water utilities in 2023 resolved the utilities' claims but did not resolve individual injury claims by residents who drank the contaminated water and developed PFAS-linked conditions.
The claimant population is residents of confirmed-contaminated communities who have drunk the contaminated water for at least a year and developed one of the recognized PFAS-linked conditions. Consumer product and occupational PFAS exposure (non-firefighter industrial workers) are additional claimant categories with different defendant structures.
